MEMORANDUM OF UNDERSTANDING
BETWEEN
THE GOVERNMENT OF
THE REPUBLIC OF KENYA
AND
THE GOVERNMENT OF THE KINGDOM OF
THAILAND
ON
COOPERATION IN THE FIELD OF PARKS AND
WILDLIFE MANAGEMENT
PREAMBLE
The Government of the Kingdom of Thailand and the Government of the
Republic of Kenya, hereinafter referred to as "the Parties",
RECALLING the Memorandum of Understanding on Cooperation in the
Field of Tourism between the Government of the Kingdom of Thailand and
the Government of the Republic of Kenya on Cooperation in the Field of
Tourism;
WISHING to strengthen the ties of friendship between their countries; and
RECOGNIZING the importance of the conservation of biodiversity and
wildlife;
Have agreed as follows:
ARTICLE I
SCOPE OF COOPERATION
1. The purpose of this Memorandum of Understanding is to
develop, promote and enhance bilateral co-operation between
the Parties through the development of technical cooperation
which will make a long-term contribution to the management of
international parks and wildlife.
2. The Parties shall endeavor to strengthen and promote
cooperation in the field of parks and wildlife management
between the Ministry of Natural Resources and Environment of
Thailand and the Ministry for Tourism and Wildlife of Kenya in
accordance with the laws of their respective countries and the
provisions of international conventions such as those concluded
under the auspices
of the Convention on International Trade in Endangered Species of
Wild Fauna and Flora (CITES) and the Convention on Biological
Diversity (CBD).
ARTICLE II
EXECUTING AGENCIES
1. The Chiang Mai Night Safari of Thailand shall be the duly
authorized executing agency on behalf of the Government of
the Kingdom of Thailand in the implementation of this
Memorandum of Understanding.
2. The Kenya Wildlife Service of Kenya shall be the duly authorized
executing agency on behalf of the Government of the Republic of
Kenya in the implementation of this Memorandum of Understanding.
ARTICLE III
COOPERATION IN PARKS AND WILDLIFE
MANAGEMENT
1. The Parties, in accordance with the legislation in force in their
countries, shall encourage all forms of cooperation with particular
emphasis on the exchange of know-how and practical experience
between the Chiang Mai Night Safari of Thailand and the Kenya
Wildlife Service of Kenya.
2. The cooperation between the Parties shall include the
development of scientific cooperation in parks and wildlife
management, the exchange live specimen and genetic
materials to improve wildlife management, and
restoration/propagation programmes.
3. To faciloperation cited above, the
Government of
the Republic of Kenya will present a number of w
enumerated in the Annex of this Memorandum of Unders
gift to the Government of the Kingdom of Thailand.
3. To facilitae the cooperation cited above, the Government of the
Republic of Kenya will present a number of wildlife animals (as
enumerated in the Annex of this Memorandum of
Understanding) as a gift to the Government of the Kingdom of
Thailand.
4. The Government of Thailand shall bear the costs associated
with capture, acclimatization, quarantine and transportation, as
well as all other costs incidental thereto.
5. The Kenya Wildlife Service will provide scientific and
technical guidance during the translocation exercise.
6. Both the Kenya Wildlife Service and the Chiang Mai Night Safari
will develop implementation protocols and procedures to ensure
compliance with existing national and international laws, rules
and regulations.
7. The Chiang Mai Night Safari shall make a bi-annual report to
the Joint Committee (as indicated in Article VI) on the
condition of the translocated wildlife.
ARTICLE IV
EXCHANGE OF STAFF AND TECHNICAL TRAINING
1. The Parties shall endeavor to strengthen long term cooperation
in the areas of parks and wildlife management through capacity
building to include the exchange of staff and experts, the
organization of scientific workshops and training opportunities.
2. The Parties shall focus on training and research in captive
animals, health care and husbandry between the two
countries and the promotion of in-situ and ex-situ wildlife 1)'
conservation and management for the benefit of the global
community.
ARTICLE V
ESTABLISHMENT OF A FUND
1. The Parties agree to establish a fund in Kenya to support the
activities of the Kenya Wildlife Service and the Chiang Mai
Night Safari. The fund shall be open-ended.
2. Financial administration shall be subjected to the laws of
the Republic of Kenya. The Thai Government will contribute to
the fund on yearly basis an amount to be agreed upon by the two
Parties. Contribution to this conservation fund will be open to all
well-wishers and friends of the Kenya Government and the Thai
Government.
ARTICLE VI
ESTABLISHMENT OF A JOINT COMMITTEE
1. A Joint Committee shall be established and composed of
representatives from the Chiang Mai Night Safari of Thailand,
the Kenya Wildlife Service and the Ministry of Tourism and
Wildlife Kenya.
2. The Joint Committee shall administer the Fund to meet the
specified objectives. The Ambassador of Thailand to Kenya
shall serve as an advisor to the Joint Committee.
ARTICLE VII
ENTRY INTO FORCE
This Memorandum of Understanding shall enter into force on the date
of signature by the Parties and will remain valid for a period of five
years. This Memorandum of Understanding shall
be automatically renewed for a subsequent period of five (5)
years.
ARTICLE VIII
TERMINATION
Either Party may terminate this Memorandum of Understanding by
giving the other party six months written notice.
ARTICLE IX
AMENDMENT
This Memorandum of Understanding may be amended by
mutual consent at the request of either Party. 5

respective Governments, have signed this Memorandum of
